This acceptable use policy applies to both personal and business web hosting services as provided by Intraplex.

Intraplex is a provider of web-hosting and other Internet-related services and as such offers its customers (referred to as "clients") and users the means to acquire and distribute public, private, commercial, non-commercial and other information. Due to the open nature of the internet and lack of a single party that owns or controls it, much of responsibility of using it acceptably falls on those who use it. Intraplex has this Acceptable Use Policy, which explains certain terms of each customer's respective service agreement, and is intended as a guide to the customer's rights and obligations when using Intraplex' web hosting and related services. Intraplex reserves the right to take certain preventive or corrective actions to protect its own and others interests.
When clients obtain information through the Internet, they must remember that Intraplex cannot monitor, warrant or verify the accuracy and quality of any information they acquire. Because of this, clients of Intraplex must use their own best judgment in relying on information obtained from the Internet or other sources, and should also be aware that some material posted to the Internet may be sexually explicit or otherwise offensive. Intraplex cannot monitor or censor the Internet, and will not attempt to do so, Intraplex cannot accept any responsibility for injury to its clients resulting from inaccurate, unsuitable, offensive or illegal Internet communications.
Intraplex does not review, edit, censor or take responsibility for any information its clients may create or acquire from the internet. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation and other harmful communication. Also, because the information created is carried over our providers network and may reach a large number of people, including both clients and non-clients of Intraplex, clients' postings to the Internet may affect other clients and may affect Intraplex goodwill, business, reputation or operations. For these reasons, clients violate Intraplex Acceptable Use Policy and the Service Agreement when they, their customers, affiliates or subsidiaries engage in the following prohibited activities:
Accessing illegally or without authorization, computers, accounts, servers or networks belonging to another party or individual, or attempting to penetrate or “break-through” security measures of another individual's system (often referred to as "hacking"). Also, any activity that may be used as a precursor to the above mentioned actions (i.e., port scan, stealth scan, man-in-the-middle attacks or other information gathering activity).
Intraplex does not allow adult or otherwise pornographic content and reserves the right to suspend/terminate/remove any account found to be hosting or distributing this content without warning.
Using our or our provider’s network or servers to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material is prohibited. Intraplex is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through its servers or network along with any other illegal material.
Use of Intraplex’s servers or network as a means to transmit, post or host negative, defamatory, harassing, abusive or threatening language or content is prohibited.
Distributing or sending unsolicited bulk and/or commercial information over the Internet. It is not only harmful because of its negative impact on consumer attitudes toward Intraplex, but also because it can overload our providers network and disrupt service to Intraplex' clients. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, Intraplex will investigate and shutdown any account deemed to be spamming. A $250 charge for violating this policy will be charged to the person initiating the SPAM. Furthermore Intraplex reserves the right to prosecute for this violation.
Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mail bombing or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service or equipment is strictly prohibited.
Use of Intraplex's service to transmit or share any material (by instant message, uploading, email, posting, hot-linking, submission, directly linking or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any party, including, but not limited to, the unauthorized copying and distribution of copyrighted material, the digitization and distribution of photographs from books, magazines or other copyrighted sources, and the unauthorized transmittal or storage of copyrighted software on Intraplex’s network or providers network.
Distributing, advertising, transmitting or making available any software, program, product, information or service that is designed to violate this acceptable use policy, which also includes the facilitation of the means to create or perform spam, flooding, mail bombing, denial of service attacks and piracy of software.
Use of Intraplex's service to collect, or attempt to collect, personal information about third parties without their knowledge, consent or in a way deemed illegal is prohibited.
Intraplex’s clients will be held responsible and accountable for any activity by third parties, using their account that violates this Acceptable Use Policy.
Engaging in activities that are determined to be illegal, including, but not limited to illegal advertising and transmitting of data, fraudulently charging credit cards and pirating software.
Engaging in or facilitating activities, whether lawful or unlawful, that Intraplex determines to be harmful or problematic to its clients, operations, reputation or customer relations.
The responsibility for avoiding harmful activities described above rests primarily with the clients of Intraplex. Intraplex will not, as a standard practice, monitor the communications of its clients to ensure that they comply with our policies or the law. However, if Intraplex becomes aware of any harmful activities, it may take any action to stop the harmful activity, including (but not limited to): Removal of information, shutting down a web site, suspension of accounts, notifying law enforcement agencies, or any other action deemed appropriate by Intraplex.
Intraplex will not intentionally monitor private electronic mail messages sent or receive by its clients, unless required to do so by law, governmental authority or when public safety is at stake. Intraplex may, however, monitor its service electronically to determine that its facilities are operating satisfactorily.
Intraplex may disclose information, including, but not limited to, information concerning a clients, a transmission made using our network, or a web site, in order to comply with a court order, subpoena, summons, discovery request, warrant, statute, regulation or governmental request. Intraplex assumes no obligation to inform the clients that clients information has been provided and, in some cases, may be prohibited by law from giving such notice. Finally, Intraplex may disclose clients information or information transmitted over its network where necessary to protect Intraplex and others from harm, or where such disclosure is necessary to the proper operation of the system.
Intraplex will never sell information to other services or outside companies.
Intraplex wishes to emphasize that, in agreeing to use out services and abide by our policies, clients indemnify Intraplex for any violation of this acceptable use policy, law or Intraplex other policies resulting in loss to Intraplex or the bringing of any claim against Intraplex by any third party. This means that, if Intraplex is sued because of a client's or customer of a client's activity, the clients will be responsible for payment of any damages awarded against Intraplex, plus costs and reasonable attorney's fees.
Intraplex reserves the right to revise, amend, or modify this Acceptable Use Policy at any time and in any manner.
